"BUDDING DESIGNERS" COMPETITION RULES
1: Organising company
The simplified joint stock company SADAS, with a capital of 21,281,200 euros, and whose headquarters are at 216 rue Winoc Chocqueel in Tourcoing (59200), France, registered with the Lille Métropole Trade and Companies Register under number 414 766 576, is organising a competition with free entry and no purchase necessary, entitled the VERTBAUDET Autumn Winter 2016 “BUDDING DESIGNERS” COMPETITION. This competition will run from 3rd June 2015 to 5th July 2015 inclusive.
This competition is available in Vertbaudet stores in France, on www.vertbaudet.fr, www.vertbaudet.de, www.vertbaudet.pt, www.vertbaudet.es, www.vertbaudet.ch, www.vertbaudet.co.uk, www.vertbaudet.com and www.laredoute.be
The competition is open to all children up to 10 years old at the date of entering (with the exception of children with a parent or member of the family employed by the organising company or by one of the companies in the CYRILLUS-VERTBAUDET GROUP or by one of the companies participating in organising this competition).
Entries are limited to one entry per child throughout the duration of the competition. One entry to include a two piece sportswear outfit design.
The child must have written permission from a parent or guardian to participate in this competition. The organising company reserves the right to ask for proof of this permission and to disqualify any participant who fails to produce said proof.
By participating in the competition, entrants must accept the terms and conditions of these rules.
Any entry that does not comply with the above guidelines will not be considered.
3: How to enter
To enter, simply send your child's design of their 2-piece sports outfit set, during the valid period of the competition stated at article 1. Permission from the child's parent or guardian must be included on the design.
The design must appear on one of the official Vertbaudet templates (Girl’s or Boy’s) only, in colour, using any art medium (pencils, felt tips, paint, pastels, collage etc.)
The child's full name and age, as well as the parent/guardian’s full name, address and telephone number followed by their authorisation must be clearly written on the each design.
Send the design:
- Either by post to the address below, marking the envelope as follows:
VERTBAUDET – Design Competition, 2 Navigation Walk, Bridge Street, Wakefield, WF90 8AB.
- Or by uploading to the website, via scanned or photograph of the template & design.
The design must not be subject to copyright. The design must not feature any branding, design, logo or other distinctive motif protected by intellectual property law and belonging to a third party. In addition, the design must not violate the creative and fun aspect of the competition: any design that fails to comply with the instructions stated above and that does not depict an accessory, as well as designs of a defamatory, abusive, or that are against moral values, will be discarded.
Once the picture has been sent you will be unable to change it.
Entries submitted that are not signed by the child's parent/guardian, or that are torn, illegible, incomplete or received after the closing date will be deemed null and void. Consequently, these entries will not be entered into the competition by the organising company.
Entries cannot be returned to the child or their parent/guardian.
4: Choosing the winners
The judging panel will be made up of three (3) salaried employees of the organising company, and will select the 7 winning designs from all the entries received on time.
The winning design will be chosen based on the criteria of creativity and technical feasibility.
In addition, the judging panel reserves the right to award a further 'special prize' if another project is judged to deserve special recognition. In this case, eight (8) winners will all receive the same prize.
The winner will see the whole or part of their two piece sportswear outfit design turned into a finished product by the organising company, to be sold under the VERTBAUDET brand name in one or more distribution channels (catalogue, shops, web) in the Autumn Winter 2016 collection, in one or all of the countries where the organising company is present, excluding any accessories shown on the design (such as jewellery etc.). However, the organising company reserves the right to create any accessories if the judging panel deems them to be essential to the general design of the Accessory. Finally, the organising company reserves the right to create only a part of the Accessory, and to alter the child's design, (in terms of shape, fabric and prints) or to combine two projects for commercial reasons.
Any alterations will be made in keeping with the child's design.
The winners (as well as any winner of the 'judging panel special prize') will receive:
- The two-piece sportswear outfit, produced by the organising company;
- One hundred and fifty pounds (£150) to spend on Vertbaudet collections, valid for one year from the date of issue, with no minimum purchase amount, to use once or several times over the phone;
- One surprise gift to the value of one hundred pounds (£100).
6: Awarding prizes
The winners will be notified by email and/or telephone by 25th July 2015 at the latest.
Prizes will be sent to the winner by registered post. The £150 to spend with Vertbaudet will be added to the winner’s parent / guardian’s credit account. Where the parent or guardian does not have an account this will be created and then closed once the £150 is fully spent. Prizes will be sent within one month of confirming the winner's address. The two-piece sportswear outfit will be sent to the winner by 31st July 2016 at the latest after the Autumn Winter 2016 collection is launched.
Prizes offered to the winner may not be contested in any way, nor is any financial alternative available (in whole or in part), nor may they be exchanged or replaced for another prize of whatever value, for whatever reason.
Any prizes sent but not received may not be contested. The organising company will decide whether any prize which cannot be awarded to the winner (or its equivalent monetary value) will either be re-allocated to another winner or donated to charity, in accordance with the Professional Code of the French Association of Home Shopping Retailers (FEVAD).
Should the circumstances require it, the organising company reserves the right to replace a prize with another of equal or higher value, especially, but not exclusively, in the case of any initially intended prize being unavailable.
7: Reimbursement procedure
Competition entrants may be reimbursed for:
- the postage cost based on current second-class postage rates;
- their internet connection costs at a set rate of sixty-one euro centimes (€0.61).
In view of the current situation regarding offers of services and technical access, since certain internet service providers offer free connection or a connection based on a flat rate (such as, in particular, cable, ADSL or specialised connections), in such cases there will be no reimbursement when subscription to a service provider forms part of the internet user’s general internet usage contract and so connecting to the site in order to enter the competition does not incur any additional fees or charges.
There can be only one reimbursement per household or IP address (same name, same address) for internet connection or postage costs, for the duration of the competition. The reimbursement request must be sent by post stating the name of the competition, full contact details of the entrant, connection dates and times where necessary, and bank account details, to the following address: Vertbaudet customer services department, 216 rue Winoc Chocqueel, 59200 TOURCOING Cedex, France, within fifteen (15) days of entering the competition for which the entrant is requesting reimbursement, as stamped by the postmark.
Reimbursement of the cost of sending the request for reimbursement can only be granted by putting in a written request, with the rate based on the current second class tariff.
Any reimbursement request including any anomaly, in particular requests that are incomplete, illegible, fail to comply with the rules, are received after the closing date or are stamped with insufficient postage, will not be considered.
Reimbursements will be made by bank transfer, within approximately three (3) months of receiving the request.
By participating in the competition, entrants automatically accept the competition rules, and waive any right to appeal concerning the way the competition was organised as well as the competition procedure, results and awarding of prizes.
The entrant must provide the full name of their parent/guardian and their declaration to prove that they legally represent the child, and the entry must carry the signatures of the parents/guardians at the time of entering.
9: Renunciation of rights
Competition winners assign to the organising company all exclusive rights to reproduce, represent and adapt the design, in whole or in part, in any country where the organising company markets its products, on any media (both online and offline, notably catalogues, promotional material, flyers and press releases etc.) for a period of two (2) years starting from 3rd June 2015, for the purposes of:
- The organising company, under the VERTBAUDET brand, creating the item or items designed by the child and selling it or them on any of the aforementioned media;
- promoting the created product (or products), which will be associated with the child's design.
In accordance with article L 131-4 paragraph 2 of the French Code of Intellectual Property rights, all lump sums are awarded with regard to promoting 'junior talent' with charges associated with marketing the winning item, bearing in mind that the organising company can in no way guarantee the commercial success of the item, and that the item will be marketed for a short period of time only.
As such, the Vertbaudet credit with a market value of one hundred and fifty pounds (£150) and the voucher with a market value of one hundred pounds (£100) are offered by the organising company in return for renouncing all ownership rights.
The winner authorises the organising company to freely reproduce, publish or present their name, age, address (country) on any media as well as featuring their design on the different retail media selling the VERTBAUDET brand (catalogue, internet, Facebook, advertising displays etc.) as proof, unless they choose to waive their winning status.
Entrants must authorise any verification of their identity, address, authorisation from parent/guardian, identity and address of the parent/guardian. Any indication that an identity or address is false or incorrect will lead to the entrant being automatically eliminated from the competition.
The organising company cannot be in any way held responsible if, in case of force majeure, events outside its control or needs are justified, it is obliged to shorten, lengthen, postpone, modify or cancel this competition at any time, should circumstances make this necessary.
The organising company cannot be held responsible for any event outside of its control, in particular as regards misdirected post, breakdown of telephone lines, unavailability of internet, technical failures meaning that the competition cannot be entered, any technical, equipment or software failures, of whatever nature, be they preventing or limiting the possibility of entering the competition or causing damage to the entrant’s system, prizes that are misdirected, lost in transit, non-received, damaged or received late.
Each entrant is responsible for taking all appropriate measures in order to protect their own data and/or software stored on their computer equipment from any attack. Any person connecting to the site in order to enter the competition is entirely responsible for the entrants.
It is strictly forbidden to modify or attempt to modify the conditions of the competition by any means, in particular by modifying the results or any part of the competition that would determine how prizes are issued and winners are chosen. The organising company reserves the right to ensure all participants have an equal chance, notably via legal means or any other suitable means.
The organising company reserves the right to exclude from the competition and prosecute any person found to have cheated or disrupted the running of the competition. A winner who is found to have cheated will be automatically stripped of any prize.
12: Data Protection
In accordance with the French Data Protection Act no. 78-17 of 6th January 1978, information requested is compulsory and required by the organising company in order to take part in the competition and for marketing purposes. Entrants, as well as their parent/guardian if they are minors, have the right to access, modify or contest information relating to them by writing to VERTBAUDET, Customer Services, 216 rue Winoc Chocqueel, 59200 TOURCOING Cedex, France and stating their full name and address.
14: Applicable law and regulations
This competition is exclusively subject to the law in force in the entrant's country of residence.
By participating in the competition, entrants automatically and fully accept the whole of the competition rules, as well as any arbitration carried out by the organising company with no right of appeal for any dispute relating to the way these rules are interpreted or applied.
These rules can be obtained free of charge on the site or can be sent free of charge to anyone submitting a written request to VERTBAUDET – 59981 TOURCOING Cedex, FRANCE. No response will be made to any requests regarding the interpretation or application of these rules, the mechanics or details of the game, or the list of winners.
These rules are regulated by SCP WARLOP, MILLOIS and SPATARI lawyers, 6 rue Faidherbe, 1st floor, BP 335, 59336 Tourcoing Cedex, France, who will be notified in the event of amendment.
